ARTICLE 1 – ORGANIZATION OF THE GAME

OFF AXIS, a SAS company with a capital of 2000 euros, whose head office is located at 15 rue Édouard Bourdet in Perpignan, registered with the RCS of Perpignan under number 814 808 374 (hereinafter the "organizing company") acting in their own name.

Organize from 07/05/2021 to 21/05/2021 (included), a free Game without obligation to purchase entitled: “Prepare yourself to bring out the aperitif boards! (hereinafter referred to as "the Game"), according to the terms described in these rules.

ARTICLE 2 – CONDITIONS OF PARTICIPATION

This free Game is open to any natural person of legal age, with internet access and a valid email address, and residing in the following countries: Metropolitan France, with the exception of the personnel of the organizing company and their families, as well as all those who participated in the development of the Game.

The mere fact of participating in this Game implies the pure and simple acceptance, without reservation, of these rules.

ARTICLE 3 – TERMS OF PARTICIPATION

This Game is a draw-type contest that takes place exclusively on the internet via the url:

on the dates indicated in article 1.

This URL is accessible from the "www.directos.eu" site, various partner sites, social networks (Facebook, Instagram, etc.), the company's E-newsletters.

Participation in the Game is as follows:

The person must complete the participation form made available to participants by providing only their email address. This form is accessible on the url mentioned above.

Only one entry per person - same e-mail address - is allowed during the entire period of the Game.

The personal data collected during the Game is intended for the organizing company in accordance with article 12 of these rules.

As the Game is accessible on a mobile phone (Smartphone), under no circumstances will Apple, Microsoft, Google or any other mobile application platform be held responsible in the event of a dispute related to the Game.

ARTICLE 4 – DESIGNATION OF WINNERS

4 winners will be drawn after the end date of the Game mentioned in article 1 within 15 days.

The draw made will determine the winners among the participants who have completed and validated the entry form.

Each winner will be contacted directly by email, by the Company within 15 days after the draw to obtain their postal address to send or communicate their winnings.

The organizing company reserves the right to verify the age of any winner before handing over their prize. Under no circumstances may the prizes be exchanged for their cash value or for any other prize. The organizing company cannot be held responsible for the use or non-use, or even trading, of the prizes by the winners.

In the event of force majeure, the organizing company reserves the right to cancel the prize(s) won without consideration.

ARTICLE 6 – IDENTIFICATION OF WINNERS AND ELIMINATION FROM ENTRY

Entrants authorize the verification of their identity and all information on the entry form. Entries for which the form is not fully completed and/or with incomplete or false contact details will not be taken into consideration and will lead to the elimination of the entry.

Similarly, non-compliance with these rules as well as any fraud or attempted cheating, regardless of its terms, will result in the outright elimination of the author's participation.

ARTICLE 7 – MODIFICATION OF GAME DATES AND EXPANSION OF THE NUMBER OF PRIZES

The organizing company cannot incur any liability in the event of force majeure or events beyond its control if it were to cancel this Game. It also reserves the right to extend or limit the period of participation, to postpone it or to modify the conditions, its responsibility cannot be engaged as a result.

Additions and modifications to these rules may be published during the Game. They will be considered as annexes to these rules. Any change will be the subject of prior information by any appropriate means after filing the amendment with the office of the Bailiff depositary of these regulations.

ARTICLE 8 – USE OF THE IDENTITY OF THE WINNERS

Your personal data is processed by the Organizing Company, acting as recipient and data controller, in accordance with applicable European and French data protection regulations.

By completing the form and sending the documents required to ensure your participation in our game, you consent to our processing and collection of your personal data. The personal data collected is mandatory. If you do not provide the required data, you will not be able to participate in the game.

They are exclusively intended for the Organizing Company for the sole purpose of taking into account your participation in the game, managing the winners, awarding prizes and meeting legal and regulatory obligations. Your data may also be used for commercial prospecting purposes, subject to your agreement.

Your personal data is transferred to our marketing and communication departments, as well as to the service providers and subcontractors to whom the Organizing Company may call for the needs of the organization and/or management of the game. subcontractors are located in the European Union.

Your personal data will be immediately deleted once the game has ended or will be kept for a maximum of 3 years if you have accepted the use of your data for commercial prospecting purposes. This period may be longer in the event of litigation risk in order to ensure the defense of our interests.

You can withdraw your consent at any time.

You have rights of access, rectification, deletion and portability of your data, limitation and opposition to the processing of your data as well as the right to define directives relating to the fate of your personal data after your death. ARTICLE 9 – REIMBURSEMENT OF PARTICIPATION FEES

Any participant can obtain, on request, the reimbursement of the costs corresponding to the estimated Game time from a landline telephone and excluding mobile participation, on the basis of a 3-minute connection at the reduced rate.

accompanied by a bank details, and a detailed invoice in the name of the participant, indicating the date and time of the connection and the exact nature of the service provided by the internet service provider and its method of invoicing ( unlimited, fixed) no later than fifteen (15) days after the closing date of the Game, as evidenced by the postmark.

The costs incurred by the participant for the stamp necessary for this request will be reimbursed on simple written request on the basis of the slow "letter" rate in force. Only one reimbursement request per participant registered in the Game and per envelope (same name(s), same address). Incomplete applications will not be considered.

As it is noted that in the current state of service offerings and technology, some Internet access providers offer a free or flat-rate connection to Internet users, it is expressly agreed that any access to the site taking place on a free or flat-rate basis (such as in particular connection by cable, ADSL or specialized link) cannot give rise to any reimbursement, insofar as the subscription to the services of the access provider is in this case contracted by the Internet user for his use of the Internet in general and that the fact for the participant to connect to the site and participate in the Game does not cause him any additional costs or disbursements.

ARTICLE 10 - RESPONSIBILITIES

Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy and risks of contamination by possible viruses circulating on the network. The organizing company declines all direct or indirect responsibility in the event of misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of the Game servers, the online telephone or any other technical connection, to the sending of forms to an incorrect or incomplete address.

It is up to all participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack.

The organizing company will make its best efforts to allow access to the Game. The organizing company may, at any time, in particular for technical reasons, updates, maintenance, interrupt access to the site and to the Game. The organizing company will in no way be responsible for these interruptions and their consequences. No compensation can be claimed in this respect.

In addition, the organizing company cannot be held liable in the event of delivery problems or loss of postal or electronic mail (in particular with regard to the delivery of prizes). Any prize sent by the organizing company to a winner which would be unclaimed or returned for any other reason by the postal services would be lost for the winner and would remain acquired by the organizing company. The organizing company cannot be held responsible for the malfunctioning of the Internet network, nor for any delay, loss or damage resulting from postal and management services.

ARTICLE 11 – INTELLECTUAL, LITERARY AND ARTISTIC PROPERTY RIGHTS

The images used on the Game site, the objects represented, the trademarks and trade names mentioned, the graphic and computer elements and the databases making up the Game site, are the exclusive property of their respective owners and cannot be extracted, reproduced or used without the written authorization of the latter, under penalty of civil and/or criminal prosecution.

ARTICLE 12 – PERSONAL DATA

The organizing company which manages the Game, implement computer processing for the purpose of managing the Game. The organizing company is responsible for the processing of personal data that may be collected.

The personal data collected will be used solely for the organization of the Game. If the participant has chosen to do so by ticking the corresponding box at the end of the questionnaire, his email address will be used to send him the newsletter. The data collected will be kept until the winners have been designated and then destroyed, unless the participant has accepted that they be kept for commercial prospecting purposes, in which case they will be kept for a maximum period of 3 years after the last solicitation (prospect) or reservation (customer).

Participants are informed that by accessing the Game website, a cookie may, if necessary, be stored on the hard drive of their computer. This is a small computer file used to record their browsing on the Game's website. Cookies are used to identify each participant in order to allow them to access information more quickly, avoiding them having to re-enter it. They can in no way damage the data present in his computer.

A participant can oppose the registration of this cookie, or choose to be notified of the registration of this cookie on his hard drive, by configuring his navigation software (the participant is invited to refer to the terms of use of its browser regarding this functionality). When this setting is made, the participant nevertheless retains the possibility of accessing the Game's website and participating in the latter.

In accordance with the "Informatique et Libertés" law of January 6, 1978 as amended and European Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data, you have a right to access and rectify information concerning you as well as a right of opposition, the right to limit processing and to erasure within the framework permitted by the European Regulation.

If he considers, after contacting the Company, that his IT rights and Freedoms are not respected, he can file a complaint with the CNIL.

ARTICLE 13 – ATTRIBUTION OF JURISDICTION AND INTERPRETATION OF THE RULES

Any possible dispute on the interpretation of the rules will be settled by the organizing company.

Participation in this Game implies the unreserved acceptance of (i) these rules in all their stipulations, (ii) the ethical rules in force on the Internet (etiquette, charter of good conduct, etc.) as well as (iii) the laws and regulations in force on French territory and in particular the provisions applicable to games and lotteries in force. No telephone or written request concerning the interpretation or application of these rules, the mechanisms or methods of the Game or the list of winners will be answered. In the event of a dispute, only a registered letter with acknowledgment of receipt sent within a maximum period of 30 days after the end date of the Game will be admissible. Except in the event of manifest errors, it is agreed that the information resulting from the systems of Game of the organizing company have probative force in any dispute regarding the connection elements and the computer processing of said information relating to the Game.

Prior to any legal action related to or in connection with these rules (in particular its application or interpretation), participants undertake to file an amicable and free appeal with the organizing company.

Participants are subject to French regulations applicable to Games and contests. Any dispute that cannot be settled amicably will be submitted to the competent courts on which the head office of the organizing company depends, unless otherwise provided by public order.
